Intellectual property rights and the administrative and civil mechanisms established to protect them

Intellectual property, or intellectual property rights, are personal moral rights. Any violation or infringement of these rights constitutes a civil wrong and a misdemeanor in its criminal form. The forms of violation vary, but they all share the commonality of causing harm to the owner.

Because intellectual property rights are of great importance, all legislation has sought to protect them and address the types and forms of violation, whether through international agreements and treaties or domestic laws related to this right. All of these mechanisms are established and utilized for prior protection through the enactment of laws prohibiting and criminalizing violations, or through compensating the injured party after the violation of their right is proven and the aggressor and violator are held accountable. Furthermore, certain administrative mechanisms exist, such as national institutes for the protection of intellectual property rights, copyright, and related rights, or through certain state-affiliated administrative agencies.

إن المكتسبات الذهنية او الحقوق الذهنية حقوق شخصية معنوية، يعد المساس بها أو التعدي عليها من قبيل الأخطاء في صورتها المدنية، ومن الجنح في صورته الجنائية وتتعدد صور الاعتداء غير أنها تشترك في أنها تسبب ضرراً لصاحبها.

ولأن الحقوق الفكرية تكتسي أهمية كبيرة وبالغة فإن كل التشريعات سعت لحمايتها والتصدي لأنواع و أشكال التعدي عليها سواء من خلال الاتفاقيات والمعاهدات الدولية أو القوانين الداخلية المتعلقة بهذا الحق، وهذه الآليات كلها مقررة ومسخرة للحماية القبلية من خلال سن قوانين تحرم وتجرم الاعتداء أو من خلال تعويض المتضرر بعد ثبوت الاعتداء على حقه وإقامة المسؤولية على المعتدي والمنتهك لهذا الحق، كذلك من خلال بعض الآليات الإدارية كالمعاهد الوطنية لحماية حقوق الملكية الفكرية وحق المؤلف والحقوق المجاورة أو من خلال بعض الأجهزة الإدارية التابعة للدولة.
