The legal framework for the crime of environmental pollution

Environmental pollution is considered one of the most complex issues of our time, capturing the attention of specialists in various fields and different human societies, regardless of their legal and social systems. The dangers surrounding the environment from pollution and the threats it poses have become a kind of challenge that humans must face. The environment has become overwhelmed and cries out for help due to the damage it has suffered as a result of this pollution, and is unable to treat it automatically. Humans have begun to suffer from the pollution of all elements of the surrounding environment, including water, air, food, and soil. The disturbing noise and harmful radiation have increased. The problem of pollution has emerged and its danger has increased with the advancement of industry and the widespread use of modern machines and tools. The major industrial countries were the first to discover this problem and its dangers and to search for appropriate solutions to address it by establishing laws that regulate the relationship of humans with their environment and regulate their behavior.

يعتبر تلوث البيئة من أعقد قضايا العصر التي تستحوذ على اهتمام المتخصصين في شتى المجالات ومختلف المجتمعات الإنسان مهما تباينت نظمها القانونية والاجتماعية فالمخاطر التي تحيط بالبيئة من التلوث وما يشوبها من تهديدات اضحت نوع من التحدي الذي يتعين على الإنسان أن يواجهه فصارت البيئة تنوء وتستغيث بما اصابها من أضرار نتيجة ذلك التلوث وتعجز عن معالجته تلقائيا واخذ الإنسان يعاني من تلوث كل عناصر البيئة المحيطة به من ماء وهواء وغذاء وتربة وزادت الضجة المؤرقة والاشعاعات المؤذية وقد برزت مشكلة التلوث وتعاظم خطرها مع تقدم الصناعة واستخدام الآلات والادوات الحديثة على نطاق واسع وكانت الدول الصناعية الكبرى سباقة الى اكتشاف هذه المشكلة ومخاطرها والبحث عن الحلول المناسبة لمعالجتها وذلك بوضع قوانين تنظم علاقة الإنسان مع وسطه وتنظيم سلوكه.
