Lowering the gaze (a comparative jurisprudential study)
غض البصر (دراسة فقهيه مقارنه)
Abstract
This research is titled "Lowering the Gaze." I followed an inductive and deductive approach. During this research, I discovered that the pure Islamic Sharia has blocked all the means that lead to committing sins. For this reason, the command came to lower the gaze and the prohibition of looking at private parts. The private parts of a man are between the navel and the knee, and the entire body of a woman is private and no stranger may look at it. Mahrams look at what is usually visible of women, such as the face, hands, neck and feet. The suitor looks at the woman’s face and hands, but the husband looks at the entire body of his wife and there is no private part between them, and his wife looks at him as well. The husband looks at his stepdaughter as he looks at his own daughter, and the doctor looks at the woman as much as necessary and no more, and so does the female doctor. Men wash as men and women wash as women, and the washer does not look at the most private parts or touch them.
جاء هذا البحث بعنوان (غض البصر) ونهجت منهج منهجًا استقرائيًّا استنباطيًّا وتبين لي خلال هذا البحث أن
الشَّريعةُ الإسلامية المُطهَّرةُ سَدَّتِ كُلَّ الذَّرائعِ المؤدِّيةِ إلى الوُقوعِ في الحَرامِ ؛ لأجْلِ ذلك جاءَ الأمرُ بغَضِّ البَصَرِ ، والنَّهيُ عنِ النَّظرِ إلى العَوْراتِ.وان عورة الرجل ما بين السرة والركبة ، وأن جميع بدن المرأة عورة لا ينظر اليها الأجنبي ، وأن المحارم ينظرون الى ما يظهر غالبا من النساء من الوجه واليدين والرقبة والقدمين ،والخاطب ينظر الى وجه المرأة ويديها ، اما الزوج ينظر الى جميع بدن زوجته وليس بينهم عورة ، وكذلك زوجته تنظر اليه ، وان الزوج ينظر الى الربيبة مثل ما ينظر الى بنته من صلبه ،وأن الطبيب ينظر الى المرأة ما تدعوا اليه الحاجه دون زيادة وكذلك الطبيبة ،وان يغسل الرجال رجال ويغسل النساء نساء ولا ينظر الغاسل الى العورة المغلظة ولا يمسها.
