Ibn Battel's Jurisprudential Directives on Financial Transactions - A Theoretical and Applied Study, with the Book of Salam as a Model

Every statement, fatwa, or ijtihad has a basis and foundation in the religion to which it can be referred for verification. However, in many cases, the mujtahid does not explicitly state his source or basis for it. This is perhaps the reason why many imitators avoid seeking evidence and reasoning, given that the fatwa is issued by someone whose knowledge and piety they trust.

Fiqh guidance is based on this premise, giving Islamic jurisprudence a comprehensive and innovative capacity. It is renewed with new events and allows for the assimilation of new developments, by referring branches to the comprehensive legal evidence that encompasses all details. It also allows for the general objectives that Islamic legislation was established to preserve, in the form of important issues that jurisprudence has paid great attention to.

This research includes some theoretical consideration of the term "fiqh guidance" in the Maliki school of thought, and an explanation of some of its meanings and aims according to Ibn Battal in financial transactions, while mentioning and discussing some examples and models of this from the book "Al-Salam."

ما من قول أو فتوى أو اجتهاد إلا وله أصل ومستند في الدين يرجع إليه عند التثبت، إلا أنه في كثير من الأحيان لا يصرح المجتهد بمأخذه أو مستنده في ذلك، ولعل هذا هو الباعث عن بعد كثير من المقلدين عن طلب الدليل والاستدلال لكون الفتوى صادرة عمن يثق في علمه وورعه.

فالتوجيه الفقهي جاء بناء على هذا الذي تقدم، فأكسب الفقه الإسلامي شمولية وخصوبة في التجديد، إذ يتجدد بتجدد الأحداث، ويسمح باستيعاب المستجدات، برد الفروع إلى الدليل الشرعي الإجمالي الشامل لكل الجزئيات، وكذا المقاصد العامة التي جاء التشريع الإسلامي ليحافظ عليها، في شكل قضايا هامة، اعتنى بها الفقه عناية كبرى.

ويشتمل هذا البحث على شيء من التنظير لمصطلح التوجيه الفقهي في المذهب المالكي وبيان لبعض معانيه ومراميه عند ابن بطال في المعاملات المالية مع ذكر ومناقشة بعض الأمثلة والنماذج على ذلك من كتاب السلم.
