Objective defenses in dowry lawsuits and their applications in Sharia courts

In this research, I have dealt with the substantive defense, which is one of the important topics in the Sharia Court Procedure Law. I have introduced the topic by defining the research terms such as defense and dowry. Then, in the first section, I have dealt with the definition of the substantive defense and the evidence for its legitimacy. In the second section, I have dealt with the divisions of the substantive defense and its conditions. In the third section, I have dealt with how to proceed with the substantive defense procedures and the means of proving it. In the fourth section, I have dealt with the substantive defenses related to the immediate and deferred dowry and the accessories of the immediate dowry. In the fifth section, I have dealt with the applications in Sharia courts of the substantive defenses in dowry lawsuits. Then, I have concluded this research with a conclusion and some results and recommendations.

لقد تناولت في هذا البحث الدفع الموضوعي ، وهو أحد الموضوعات المهمة في قانون أصول المحاكمات الشرعية ،حيث قمت بالتمهيد للموضوع بالتعريف بمصطلحات البحث كالدفع والمهر، ثم تناولت في المبحث الأول تعريف الدفع الموضوعي وأدلة مشروعيته، وفي المبحث الثاني تناولت أقسام الدفع الموضوعي و شروطه، وفي المبحث الثالث تناولت كيفية السير في إجراءات الدفع الموضوعي، ووسائل إثباته، وفي المبحث الرابع تناولت الدفوع الموضوعية المتعلقة بالمهر المعجل والمؤجل وتوابع المهر المعجل، وفي المبحث الخامس تناولت التطبيقات في المحاكم الشرعية للدفوع الموضوعية في دعاوى المهور، ثم اختتمت هذا البحث بخاتمة وبعض النتائج والتوصيات.
