Abstract
This research aims, on the one hand, to clarify the role of Islamic Law in establishing rules and principles for the preservation of the human soul, whether in a state of peace or war, and on the other hand, it seeks to impart alertness and awareness to the human conscience in reaching agreed-upon rules in order to guarantee and protect people who are victims of armed conflicts. Wars and natural disasters, and this is demonstrated through international humanitarian law On the third hand, this research also aims to determine the formula and difference between Islamic law and international law in the field of human rights and outsourcing.
يهدف هذا البحث من جهة أولى إلى بيان دور الشريعة الإسلامية في إرساء قواعد ومبادئ للحفاظ على النفس البشرية سواء في حالة السلم أو الحرب، ومن جهة ثانية يسعى إلى إضفاء يقظة الضمير الإنساني ووعيه في الوصول الى قواعد متفقة عليها من أجل ضمانة وحماية الناس ضحايا النزاعات المسلحة والحروب والكوارث الطبيعية وتجلى ذلك من خلال القانون الدولي الإنساني، كما يهدف هذا البحث من جهة ثالثة إلى الوقوف على أوجه الاتفاق والاختلاف بين الشريعة الإسلامية والقانون الدولي الإنساني في معالجة المشاكل الإنسانية الناجمة عن النزاعات المسلحة وغيرها.
