الحوكمة الشرعية للشبابيك الإسلامية في الجزائر

عتبر الشبابيك الإسلامية في الجزائر التابعة للمصارف الربوية حديثة النشأة، وبحاجة إلى توجيه وتصويب من طرف الخبراء والمتخصصين، والاستعانة بالدول العربية والإسلامية السّبّاقة في هذا المجال، وقد جاءت هذه الدراسة لتأكيد ضرورة وجود إطار حوكمة شرعية للشبابيك الإسلامية لضمان التزامها بالأحكام الشرعية وعدم مخالفتها لها، ويسعى هذا البحث إلى التعرف على مفهوم الحوكمة الشرعية مرتكزاتها ومبادئها التي تقوم وتعتمد عليها، ثم بيان وظائفها وعناصرها التي تضمن تطبيق حوكمة شرعية فاعلة، مع ضمان التزام الشبابيك الإسلامية بتطبيقها، كما ستركز الدراسة على مفهوم الشبابيك الإسلامية ومعايير انشائها، مع التطرق لبيان الإطار التشريعي للشبابيك الصيرفة الاسلامية في الجزائر في ظل النظام 20-02 المؤرخ في 15مارس 2020 والذي يحدد العمليات البنكية المتعلقة بالصيرفة الإسلامية، والقواعد المطبقة عليها، وشروط ممارستها من طرف البنوك والمؤسسات المالية، ويليه الحديث على أهم إشكالات حوكمة الشبابيك الإسلامية في الجزائر، وتقديم بعض المقترحات لأفضل الممارسات للشبابيك الإسلامية في الجزائر، وضرورة تطبيق الحوكمة الشرعية لضمان نجاحها واستمرارها، مع ضمان عدم وقوعها في المعاملات المحرمة.

Islamic windows in Algeria, affiliated with usurious banks, are considered newly established and in need of guidance and correction by experts and specialists, and the assistance of pioneering Arab and Islamic countries in this field. This study came to confirm the necessity of a Sharia governance framework for Islamic windows to ensure their compliance with Sharia provisions and not violate them. This research seeks to identify the concept of Sharia governance, its foundations and principles on which it is based and relied upon, then to explain its functions and elements that ensure the implementation of effective Sharia governance, while ensuring the commitment of Islamic windows to implement it. The study will also focus on the concept of Islamic windows and the criteria for their establishment, while addressing the legislative framework for Islamic banking windows in Algeria under Regulation 20-02 dated March 15, 2020, which defines banking operations related to Islamic banking, the rules applied to them, and the conditions for their practice by banks and financial institutions. This is followed by a discussion of the most important issues of governance of Islamic windows in Algeria, and the presentation of some proposals for best practices for Islamic windows in Algeria, and the necessity of implementing Sharia governance to ensure their success. And its continuity, while ensuring that it does not involve prohibited transactions.
